7) Limitation of liability
FunkyBreslev implements reasonable measures to ensure the availability and security of the site. However, FunkyBreslev cannot be held liable for service interruptions, bugs, viruses, or indirect damages related to use of the site, except in cases of gross negligence, willful misconduct, or bodily injury. This clause does not affect the rights the consumer holds under the mandatory provisions of the French Consumer Code and Civil Code, in particular the legal guarantee of conformity and the guarantee against hidden defects.
8) Governing law and jurisdiction
This legal notice is governed by French law. For the jurisdiction rules applicable in the event of a dispute, see article 21 of the Terms of Sale below.

1. Purpose
These Terms of Sale (hereafter the "Terms") govern sales of digital and physical products entered into between FunkyBreslev (hereafter the "Seller") and any adult individual acting as a non-professional (hereafter the "Customer" or "Consumer") via the website funkybreslev.com.
Any order placed on the site implies full and unreserved acceptance of these Terms by the Customer. The Customer acknowledges having read them before confirming their order, via a checkbox provided for this purpose. The applicable Terms are those in effect on the date the order is confirmed.

The Seller offers the following product categories. All applicable prices are shown in euros (€) on funkybreslev.com at the time of purchase and may be changed at any time without notice. Prices shown are inclusive of all taxes (VAT not applicable, art. 293 B of the French Tax Code).
3.1 — Digital products
The Collection — Download: the complete FunkyBreslev discography available as of the order date, in mastered MP3 format (320 kbps), delivered as an immediate download in archive form. The catalog keeps growing: the number of tracks included corresponds to the catalog available at the time of the order.
3.2 — Physical products
The Collection — USB key: a premium LEXAR 3.2 USB key (64 GB) containing the complete FunkyBreslev discography available as of the order date, in mastered MP3 format (320 kbps), presented in a custom FunkyBreslev case with a signed presentation booklet and premium envelope. Shipped from France by La Poste with tracking.
The essential characteristics of each product (title, audio format, duration, tracklist where applicable, content) are specified on the corresponding product page.
4. Ordering
Orders are placed directly on funkybreslev.com. The process includes:
Selecting the product and adding it to the cart
Confirming the cart
Entering the necessary information (name, email, and shipping address for physical products)
Expressly accepting these Terms via a checkbox
Choosing the payment method and paying
Order confirmation sent by email
For digital products: confirming the order, after accepting these Terms — of which article 7.1 informs the Customer of immediate delivery and the waiver of the right of withdrawal — constitutes express consent to immediate performance of the contract and an explicit waiver of the right of withdrawal in accordance with Article L.221-28 13° of the French Consumer Code. This waiver is restated in the order confirmation email.
The order becomes firm and final once payment is confirmed by the payment provider. The Seller reserves the right to refuse any order for a legitimate reason (abnormal order, suspected fraud, prior dispute).
5. Prices and payment
Prices are shown in euros, inclusive of all taxes (VAT not applicable, art. 293 B of the French Tax Code). Any shipping costs for physical products are shown separately before the order is confirmed.
Payment is secured and processed by Stripe. Accepted payment methods are shown on the site at the time of order. The Seller retains no banking data.
6. Delivery
6.1 — Digital products (The Collection — Download)
Immediate access to download after payment is confirmed. A secure, personal, time-limited download link is sent by email. If it expires, a new link can be obtained using the order email or on request to contact@funkybreslev.com.
6.2 — Physical products (The Collection — USB key)
USB keys are shipped from France by La Poste with a tracking number. A confirmation email containing the tracking number is sent upon shipment.
Shipping costs:
France: shipping included in the displayed price
International: flat rate shown before the order is confirmed, tracked shipping
Estimated delivery time: 2 to 4 business days within France. 7 to 20 days internationally depending on destination. Any customs duties, import taxes, or clearance fees imposed by the destination country are the Customer's sole responsibility.
The Seller cannot be held liable for delivery delays attributable to the carrier or to the customs services of the destination country.
If a parcel is declared lost by the carrier (following an inquiry with La Poste), the Seller will reship the product or issue a full refund, at the Customer's choice.
Retention of title: physical products remain the Seller's property until full payment has been received from the Customer.
7. Right of withdrawal
7.1 — Digital products (The Collection — Download)
In accordance with Article L.221-28 13° of the French Consumer Code, the Customer expressly waives their right of withdrawal at the time of order. This waiver results from the combination of the following elements:
Express acceptance of these Terms via a checkbox before the order is confirmed, article 7.1 clearly informing the Customer of immediate delivery and the waiver of the right of withdrawal
The order confirmation email restating this waiver
Consequently, no withdrawal is possible once the download or access link has been received. All sales of digital products are final.
7.2 — Physical products (The Collection — USB key)
The Customer has 14 days from receipt of the product to exercise their right of withdrawal, in accordance with Article L.221-18 of the French Consumer Code.
Exception: in accordance with Article L.221-28 6° of the French Consumer Code, the right of withdrawal cannot be exercised for sealed goods containing digital content that have been unsealed after delivery. USB keys (The Collection) are shipped in original sealed packaging (shrink wrap). Opening the sealed packaging constitutes access to the digital content and forfeits the right of withdrawal.
How to exercise this right: to exercise the right of withdrawal, the Customer must notify their decision by email to contact@funkybreslev.com or by mail to the Seller's address, using the model withdrawal form found in the appendix to these Terms or any other unambiguous statement.
Returning the product: the Customer must return the product in its original packaging, intact and sealed, within 14 days of notifying the withdrawal. Return shipping costs are borne by the Customer.
Refund: in the event of a valid withdrawal, the Seller will refund all sums paid (excluding any additional initial shipping costs linked to choosing a more expensive delivery method than the standard one) within 14 days of receiving the returned product or proof of its shipment by the Customer, using the same payment method as the original order.
8. Legal guarantees
Independently of these Terms, the Customer benefits from the following legal guarantees:
Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code): the Seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The Customer has 2 years from delivery to take action. For digital content supplied as a single delivery, the period is 2 years from supply. The Customer may choose between repair, replacement, or, where applicable, termination of the contract or a price reduction, under the conditions provided by law.
Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Seller is liable for hidden defects in the goods sold that render them unfit for their intended use, or that reduce this use to such an extent that the Customer would not have acquired them, or would have paid a lower price, had they known of them. The Customer has 2 years from discovery of the defect to take action.

9. License to use
All products sold by FunkyBreslev are licensed for private, non-commercial listening only.
The following are strictly prohibited without the Seller's prior written authorization:
Public broadcast (social media, nightclubs, bars, shops, fairs, etc.)
Audiovisual synchronization (advertising, film, TV series, online video, etc.)
Streaming on third-party platforms (Spotify, Apple Music, YouTube, etc.)
Resale, redistribution, or sharing of files
Any professional or commercial use, direct or indirect
Any violation of the foregoing constitutes an infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code, subject to civil and criminal prosecution.
10. Specific conditions — The Collection — Download
Contains the complete FunkyBreslev discography available as of the order date.
Delivered as an immediate download after payment is confirmed, in archive form.
Files provided in mastered MP3 format (320 kbps).
The price changes based on the number of tracks in the catalog. The applicable price is the one shown on the site at the time of order.
The Collection only includes tracks available as of the purchase date. Releases published after that date are not included; they are available through the Premium Pass (article 12).
Private, non-commercial listening license in accordance with article 9.
11. Specific conditions — The Collection — USB key
Physical product: premium LEXAR 3.2 USB key (64 GB) in a custom FunkyBreslev case, with a signed presentation booklet and premium envelope.
Contains the complete discography available as of the order date, in mastered MP3 format (320 kbps).
The price changes based on the number of tracks in the catalog. The applicable price is the one shown on the site at the time of order.
Shipped in original sealed packaging. Opening the seal forfeits the right of withdrawal (see article 7.2).
Private, non-commercial listening license in accordance with article 9.
12. Specific conditions — Premium Pass (annual subscription)
Nature: the Premium Pass is an annual subscription granting access to a personal online space allowing streaming and download of the entire FunkyBreslev catalogue available during the subscription, as well as new releases published during that period. The audio format is mastered MP3 (320 kbps).
Price: €85 incl. tax for the first year, then €39 incl. tax per year on renewal. VAT not applicable — article 293 B of the French General Tax Code.
Automatic renewal: in accordance with article L.215-1 of the French Consumer Code, the subscription renews automatically for successive one-year periods at the renewal price in force (€39/year). The Seller informs the Customer, by email, of the renewal date and of the option not to renew, at the latest one (1) month before the end of the current period.
Cancellation: the Customer may cancel at any time, free of charge and without justification, from the member space (“Manage membership” button, which opens the payment provider’s secure management portal) or by email to contact@funkybreslev.com. Cancellation takes effect at the end of the period already paid for: the Customer keeps access to the space until that date, with no further charge. In accordance with article L.215-1 paragraph 3 of the French Consumer Code, if the renewal notice was not sent as required, the Customer may terminate the subscription free of charge at any time from the renewal date, and any amounts wrongly collected are refunded.
Right of withdrawal: as the subscription concerns the supply of digital content with immediate performance, by validating the order the Customer expressly requests immediate access to the service and waives the right of withdrawal, in accordance with article L.221-28 13° of the French Consumer Code (checkbox at payment, see article 7.1).
Downloaded tracks: files downloaded by the Customer during the subscription remain theirs for private, non-commercial use (article 9), including after the subscription ends. Access to the space, streaming and new releases, however, ceases at the end of a non-renewed subscription.

14. Consumer mediation

15. Liability
The Seller implements reasonable measures to ensure the availability of the site, the integrity of delivered files, and the security of transactions. However, the Seller cannot be held liable for service interruptions, data loss, bugs, viruses, or indirect damages related to use of the site or of the delivered files, except in cases of gross negligence, willful misconduct, or bodily injury.
This clause does not affect the rights the Customer holds under the mandatory provisions of the French Consumer Code and Civil Code, in particular the legal guarantee of conformity and the guarantee against hidden defects (see article 8).
16. Force majeure
The Seller cannot be held liable for any failure or delay in performing its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code (strike, natural disaster, pandemic, telecommunications network failure, etc.).
17. Personal data
The processing of personal data is governed by the Privacy Policy available on the site, in accordance with the GDPR and the French Data Protection Act.
18. Intellectual property

19. Amendments to the Terms
The Seller reserves the right to amend these Terms at any time. The applicable Terms are those in effect on the date the order is confirmed. Amended Terms take effect as soon as they are published on the site.
20. Severability
Should any provision of these Terms be declared void or deemed unwritten pursuant to a law, regulation, or final court decision, the remaining provisions shall retain full effect.
21. Governing law and jurisdiction
These Terms are governed by French law.
For disputes with a Consumer, the jurisdiction rules of the French Consumer Code and Regulation (EU) No. 1215/2012 (Brussels I bis) apply: the Consumer may bring proceedings, at their choice, before the court of their own domicile or that of the Seller.
For disputes with a business, exclusive jurisdiction is given to the courts of Lyon, France.
